用户使用 OpenAva 创建的 Agent 配置、提示词、技能、自动化流程、对话内容、文件处理结果和其他工作成果，其权利归用户或原权利人所有。OpenAva 不对用户内容或工作成果的内容承担任何法律责任，由用户自行承担其产生的一切责任。
用户应确保其输入、上传、处理、生成或分享的内容不侵犯他人的知识产权、隐私权、商业秘密或其他合法权益。
本应用目前不提供独立的云端备份功能。用户在 OpenAva 中创建或编辑的 Agent、对话、记忆、技能、工作区和项目数据，保存在用户本机设备或用户个人控制的 iCloud 存储中。如用户在应用内删除内容，或卸载本应用，相关数据可能会被永久删除，我们无法为用户恢复。
用户应自行做好数据备份。因用户删除内容或删除/卸载本应用而导致的 Agent 配置、对话、文件、项目或其他数据丢失，由用户自行承担责任，我们对此不承担任何法律责任。
OpenAva 可能允许用户连接第三方大型语言模型、API 服务、本地模型或其他外部服务。用户使用这些服务时，应自行遵守相关第三方服务的服务条款、隐私政策、使用限制和费用规则。
第三方服务的可用性、输出结果、准确性、安全性和合规性不由我们控制。因第三方服务故障、模型输出错误、账号限制、费用变化、数据处理或其他行为导致的任何损失，由用户自行承担。
OpenAva 及其连接的 AI 模型可能生成不准确、不完整、过时或不适当的内容。用户应自行判断和验证 AI 输出，不应将其作为法律、医疗、财务、投资、安全或其他专业建议的唯一依据。
用户基于 AI 输出采取任何行动所产生的后果，由用户自行承担。我们不对您因依赖 AI 输出而遭遇的任何直接或间接损失承担责任。

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.
You're not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Day1 Labs.
This application is intended for users 4 years of age and older. Users under 4 should use the app under the guidance of a parent or guardian.
The rights to agent configurations, prompts, skills, automation workflows, conversation content, file processing results, and other work product created by users using OpenAva belong to the users or the original rights holders. OpenAva does not assume any legal responsibility for user content or work product, and users themselves assume all responsibilities arising from them.
Users must ensure that content they input, upload, process, generate, or share does not infringe the intellectual property rights, privacy rights, trade secrets, or other lawful rights of others.
The app currently does not provide an independent cloud backup service. Agents, conversations, memories, skills, workspaces, and project data created or edited by users in OpenAva are stored on the user's local device or in the user's personally controlled iCloud storage. If a user deletes content within the app or uninstalls the app, relevant data may be permanently deleted, and we cannot recover it for the user.
Users should perform their own data backups. Loss of agent configurations, conversations, files, projects, or other data due to the user's deletion of content or deletion/uninstallation of the app is the user's sole responsibility, and we assume no legal liability for such loss.
OpenAva may allow users to connect third-party large language models, API services, local models, or other external services. When using these services, users must comply with the relevant third-party service terms, privacy policies, usage restrictions, and fee rules.
The availability, output, accuracy, security, and compliance of third-party services are not controlled by us. Users are solely responsible for any loss caused by third-party service failures, incorrect model outputs, account restrictions, fee changes, data processing, or other actions.
OpenAva and the AI models connected to it may generate inaccurate, incomplete, outdated, or inappropriate content. Users should independently evaluate and verify AI outputs, and should not rely on them as the sole basis for legal, medical, financial, investment, safety, or other professional advice.
Users are solely responsible for the consequences of any actions taken based on AI outputs. We accept no liability for any loss, direct or indirect, you experience as a result of relying on AI outputs.
At some point, we may wish to update the app. The app is currently available on iOS and macOS – the requirements for the system may change, and you'll need to download the updates if you want to keep using the app. We do not promise that it will always update the app so that it is relevant to you and/or works with the system version that you have installed on your device. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination:
All paid features of this application (if any, including one-time purchases and subscriptions) are processed through the Apple App Store and are subject to Apple's relevant terms. If you are dissatisfied with a purchase, you can apply for a refund from Apple within the period specified by Apple.
If you have activated a subscription service, you can manage or cancel your subscription at any time in the "Subscriptions" settings of your Apple ID. Fees generated by third-party models, APIs, or external services are charged by the corresponding service providers and are subject to their terms.
We may update our User Agreement from time to time. Thus, you are advised to review this page periodically for any changes. These changes are effective immediately after they are posted on this page.
